Fixed-line mis-selling investigation

Ofcom has today published details of an investigation into two companies as part of its ongoing program to enforce new regulations designed to prevent mis-selling in fixed-line telecoms.

Ofcom is investigating two Birmingham based communications providers: FreeCall and Orb Communications. This follows more than 600 complaints from consumers and small businesses about the sales and marketing activity of these two companies.

Ofcom is investigating both companies under both the Communications Act 2003 and the Enterprise Act 2002. FreeCall, Orb and their directors now have 14 days to sign legally binding commitments to change their sales and marketing practices.

If undertakings are not signed within this period, Ofcom may apply to the courts to seek enforcement orders against the two companies and their directors.
